Digital Content:

Physical Goods:

Risk transfers to you upon delivery by courier.
Ownership transfers upon full payment.
Delivery estimates are indicative only and may vary by country and carrier.

10. Intellectual Property

10.1 All intellectual property, including copyrights, trademarks, and digital works, belong to NUBELIX or its licensors.
10.2 You are granted a limited, non-exclusive, revocable, non-transferable license to use purchased Digital Content for personal, non-commercial use.

11. Refunds, Cancellations, and Returns

11.1 Digital Content

Non-refundable once download or streaming access is granted.
By purchasing Digital Content, you expressly consent to immediate delivery and waive your withdrawal right under EU and U.K. consumer law.
In the U.S. and Canada, all digital sales are final unless the file is defective or inaccessible due to our fault.

11.2 Personalized Merchandise

Non-refundable after confirmation of customization details.
Errors arising from user-provided data are the user’s responsibility.
Refunds are issued only for defective or damaged products upon verified claim.

11.3 Standard Merchandise

Consumers in the EU, U.K., and Canada have a 14-day withdrawal period from delivery to cancel for any reason.
Returned goods must be unused and in their original packaging.
Refunds will be processed within 14 days of receiving the return or proof of dispatch.

12. Warranties

12.1 Digital Content: NUBELIX warrants that digital materials will function as described and be free from major defects for 90 days after purchase.
12.2 Physical Goods: Covered by statutory warranties:

EU/UK: 2–3 years (depending on country).
Canada/U.S.: Implied warranty of merchantability and fitness for purpose.
12.3 The warranty excludes damage caused by misuse, modification, or neglect.

13. Limitation of Liability

To the fullest extent permitted by law:

NUBELIX is not liable for indirect, consequential, or punitive damages (including lost profits, data, or business).
NUBELIX’s total liability shall not exceed the total amount paid for the product or service giving rise to the claim.
Nothing excludes liability for death, injury, fraud, or gross negligence where legally prohibited.

Consumers in the EU, U.K., Canada, and certain U.S. states retain their statutory rights, which are not waived by this clause.

14. Force Majeure

We are not responsible for non-performance due to events beyond our control, including but not limited to natural disasters, strikes, cyberattacks, supply chain disruptions, or government restrictions.

U.S. Users: Governed by the laws of the State of Delaware, excluding conflict of law principles.
